Terms of Service

These Terms of Service (“Terms”) govern your use of Adaptus: NCLEX Prep (“Adaptus,” “the app,” “we,” “us”), an application operated by Taisen Industries LLC. By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. The service

Adaptus is an educational study tool that provides adaptive practice questions, review content, progress tracking, and readiness estimates to help you prepare for the NCLEX-RN examination. We may add, change, or remove features at any time.

Educational use only; no guarantee of results. Adaptus is a study aid. It does not provide medical, clinical, or professional advice, and it is not a substitute for an accredited nursing education. We do not guarantee that using Adaptus will result in a passing score on the NCLEX or any other examination.

NCLEX® and NCLEX-RN® are registered trademarks of the National Council of State Boards of Nursing, Inc. (NCSBN). Adaptus and Taisen Industries LLC are not affiliated with, endorsed by, or sponsored by NCSBN. NCSBN does not review, endorse, or sponsor this product.

2. Eligibility

You must be at least 13 years old to use Adaptus. If you are under 18 (or the age of majority where you live), you may use the app only with the involvement and consent of a parent or legal guardian. By using the app, you represent that you meet these requirements.

3. Your account

You agree to provide accurate information when creating your account.
You are responsible for keeping your password confidential and for all activity under your account.
You agree to notify us promptly of any unauthorized use of your account.
You may not share, sell, or transfer your account to anyone else.

4. Purchases and payments

Adaptus offers free use with a daily limit on practice questions, and an optional one-time purchase that unlocks unlimited access (the “lifetime unlock”).

Purchases are processed by Apple through the App Store using in-app purchase. Payment is charged to your Apple Account.
The lifetime unlock is a one-time, non-consumable purchase. You can restore it on devices signed in to the same Apple Account.
Prices are shown in the app before purchase and may change over time; changes do not affect purchases already completed.
Refunds for App Store purchases are handled by Apple, not by us, in accordance with Apple’s policies. To request a refund, contact Apple Support.

5. Acceptable use

You agree not to:

Copy, scrape, redistribute, resell, or publicly post the app’s questions, explanations, or other content;
Reverse engineer, decompile, or attempt to extract the source code or underlying data, except where permitted by law;
Interfere with, disrupt, or attempt to gain unauthorized access to the app or its systems;
Use the app for any unlawful purpose or in violation of these Terms.

6. Intellectual property

The app and its content — including questions, explanations, review material, text, graphics, and software — are owned by Taisen Industries LLC or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the app for your own study. All rights not expressly granted are reserved.

7. Disclaimer of warranties

The app is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its content is complete or accurate for any particular purpose.

8. Limitation of liability

To the fullest extent permitted by law, Taisen Industries LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the app. To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the amount you paid us for the app in the twelve months before the claim.

9. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the app in a way that could harm us or other users. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

10. Apple App Store terms

The following applies because you obtained the app through the Apple App Store:

These Terms are between you and Taisen Industries LLC only, not with Apple. Apple is not responsible for the app or its content.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Apple is not responsible for addressing any claims relating to the app, including product-liability, legal-compliance, or consumer-protection claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will revise the effective date above and, where appropriate, notify you within the app. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the app will be subject to the exclusive jurisdiction of the state and federal courts located in California.
